Effective 31 August 2026
Terms of Service
The rules for using Ya, written for people rather than legal departments.
These Terms are an agreement between you and Individual Entrepreneur Daniel Tcytkin (ID 343575410), registered in Georgia, who operates ya.danielcreates.xyz (“Ya”, “I”, or “the service”). If you use Ya, you agree to these Terms.
1. What Ya is
Ya helps you organise the work you do with your psychologist between sessions. You can keep sessions, transcripts, notes, questions, analyses, terms, and small practices in one place. The core service is free. Optional built-in AI features use paid AI credits.
2. Who can use it
You must be at least 18 and legally able to use the service where you live. I may restrict access when required by law, sanctions, a service provider, or a serious security risk.
3. Your account
Give accurate account information, keep your login details private, and tell me promptly if you think someone else has accessed your account. Accounts may not be shared or transferred. I may suspend an account to protect users, investigate misuse, comply with law, or enforce these Terms.
4. Your content
Your content remains yours. You give Ya only the permission needed to store, transmit, and process it to provide features you request, keep the service secure, and meet legal obligations. Do not upload content you have no right to use or disclose.
5. Recording conversations
Recording laws differ between countries and situations. Before recording anyone, make sure you have the legal right to do so and obtain every consent required by law or professional rules. A checkbox in Ya cannot make an unlawful recording lawful.
6. AI features
AI features are optional and run only when you request them. The data needed for that request may be sent to the providers described in the Privacy Policy. AI can be wrong, incomplete, biased, or misleading, so review its output before using it.
7. Not healthcare or emergency support
Ya is an organisational tool. It does not provide medical care, psychotherapy, diagnosis, crisis support, or professional advice, and it does not replace a qualified professional. In an emergency or crisis, contact local emergency or crisis services.
8. Sharing with a psychologist
You may give a psychologist access to selected sessions, analyses, and terms. They may view those materials and leave comments. Access lasts until you revoke it. You are responsible for choosing the right person, and psychologists remain responsible for their own professional and legal duties.
9. AI credits and payments
AI credits may be sold in packages without a subscription. They do not expire while your account remains active. Credits are not money, stored value, property, or a financial asset. They cannot be transferred, resold, traded, or redeemed for cash.
Real payments are not enabled yet; Paddle Checkout may be shown in sandbox mode for testing without charging money. When live payments are activated, Paddle will be the Merchant of Record and authorised reseller. The price, taxes, package size, and Paddle’s purchaser terms will be shown before you pay.
10. Acceptable use
Do not access another person’s account or data, bypass security controls, upload malicious material, disrupt or scrape the service, resell access, infringe anyone’s rights, record unlawfully, or use Ya for illegal or seriously harmful activity.
11. Availability and liability
I may change, suspend, or discontinue features. I take reasonable care, but I cannot promise that Ya will always be available or error-free. To the fullest extent allowed by law, I am not responsible for indirect or consequential loss, professional decisions, AI output, or events outside my reasonable control. Nothing in these Terms limits rights or liability that the law does not allow me to limit.
12. Privacy, deletion, and changes
The Privacy Policy explains how personal data is handled. You can request a JSON or ZIP export and delete your account. Account access is blocked promptly, and permanent deletion is completed within 10 working days, except for limited backups and records that must be kept by law.
I may update these Terms when the service or law changes. Material changes will receive additional notice where required.
13. Law and contact
These Terms are governed by the laws of Georgia. Mandatory rights that apply where you live still apply. Courts in Georgia have jurisdiction unless mandatory law gives you the right to bring a claim elsewhere. Before starting a formal dispute, please email hello@ya.danielcreates.xyz so we can try to resolve it.
